PS3 Faces Ban Over Patent Infringement For A Third Time

Like bottom feeders on a whale, big targets such as Sony and Microsoft are in constant states of litigation. Sony alone already has three legal actions against its Blu-ray format, the latest of which has recently been filed in a Texan court by Orinda Intellectual Properties USA.
Orinda claim that Sony has performed a patent infringement over it's Blu-Ray technology, citing patent number 5,438,560, an incredibly vague patent that seems to cover basically anything that is an optical disk. The patent was originally filed by Hyundai in October 1993 and granted by the US Patent Office in August 1995.
The action asked for is an injunction on all Blu-ray technology, meaning that if the courts ruled for Orinda, the PS3 would be banned from sale.
With the threat of this established, Orinda is asking for a ‘reasonable royalty' from Sony for using its technology... an offer, Orinda would be hoping, they can't refuse.
It is incredibly unlikely that the action will go any further, and at worst the ransom is sure to be paid by Sony. But by the sounds of the patent, this is just another blatant attempt to extort a wealthy business. Back to your bottom feeding Orinda.
